Grandparents often experience difficulty in seeing their grandchildren for a variety of reasons. Grandparents apply to the court for a contact order, and in certain circumstances a residence order, to see their grandchildren. Masters Legal Services have helped grandparents obtain rights through the courts and, where appropriate, represented grandparents interests at children’ hearings out with the court.

Children and parents may have different ideas about what is in the child’s interests when considering contact and residence. The law presumes that a child is old enough to form a view about contact and residence. If they wish to express their view and they are aged 12 or over then their view must be taken account of. If  your child wishes to speak to a Solicitor then he or she would be entitled to Legal Aid and for advice and also for representation in a court action.

In order to adopt a child an application has to be made to the Sheriff who will make a decision whether to approve the adoption after considering all of the evidence before the him or her. Whether to Divorce or simply to Separate is often a difficult decision to make. It is important to consider the arrangements for the care of the children; who will your children live with? How often will the other parent see the children? Do your Children have their own views on this important question?
